The select committee report on the Copyright (New Technologies and Performers' Rights) Amendment Bill has landed. It's a mixed bag.

You'll have to delete your digital copy if you part company with the original CD. The sunset clause is gone. And the committee wants the bill amended "to make it clearer that copyright owners always have the option of contracting out of all of the permitted acts.

Meh. May as well ban blowjobs like they did in the State of Georgia, or was it Alabama?

Double Meh. I guess now rather than fighting for sane laws, we return to our position of praying for the swift demise of the current Big Media business models?

Are there still laws on the books protecting the rights of buggy whip manufacturers?

I have no problem witn this provided that at the time of purchase they get a contract signed and witnessed by their agent and the purchaser.

Good point. The status of shrink-wrap contracts is pretty much untested in NZ.

Oh, and also, the select committee seems to have missed the point on the silly ban on time-shifting programmes for which there is an on-demand alternative. So it looks like the bill will go forward with a provision that would outlaw using your PVR or VCR to record much of the schedule on TV One and TV2. Note that TVNZ specifically said in its submission that the measure was unrealistic and unnecessary. Go figure.

We also recommend rewording section 84(1)(c) to clarify that a time-shifted recording must not be made from an on-demand
service.

So capturing free content streamed off the TVNZ on demand site is now forbidden. go figure,

Most people aren't aware of their rights, and are easily dissuaded by statements such as "it was in the contract". As is pointed out, a contract is only a contract when both parties realise they've agreed to a contract.
</reality check> Who among us actually reads ALL the terms and conditions before ticking "I Agree" on the internet?

Also.
Funny you should bring up The Simpson's On Drugs. When my child was still toddling and going thru the Noddy phase I was struck by one particular episode called "Noddy & The Magic Powder". The naughty goblins were distributing a magic powder to everyone in Toytown that rendered them incapable of doing anything except dance. They danced and danced and danced while the naughty goblins robbed the town. Obviously the writers were up to mischief - all it needed was a stomping house beat to make their point further!

I also recently came across some YouTube vids of the old 80's TV Show Facts Of Life. It's a bit hamfisted but you gotta give 'em credit for taking on the subject of marijuanna use amongst teens. They talk about bongs, joints, roaches, and selling your Mum's stuff to buy drugs -- it's almost a "How To..."

Tootie's Bong

and

The Facts Of Life Stoned

__(One of them even features a young Helen Hunt)

Maybe this problem can be solved by an ammendment allowing police discretion over whether or not to prosecute.

Plus, if your friends come around, you can't show them the programmes you've time-shifted off the telly.

Didn't Greg O'Connor from the Police Association say that under the proposed legislation the Police would be forced to investigate each and every reported case of time-shifted recording?

Now I have not been accused of being a big critic of this Government, but surely this is one of the worst bits of legislation that has been passed in a long time. Something that hand over the right to make criminals of folks to the whim of corporates is just nuts. I also confidently predict that not a single NZ artist will be better off as a result of these changes.

Judith Tizard, if it is she who is still responsible for this, deserves all the brickbats coming her way.

Subversive story lines are fantastic.
Was the episode on vid or in a book.
I was outraged as a kid when Getafix the Asterix Druid had his name changed for the movie.
And can anyone get Cpt Pugwash with the orig character names, Master Bates & Roger the Cabin Boy?
Wrong stories for kids but brilliant for big kids.

If we're going to talk about subversive children's television programmes, then the naughty Rainbow episode must be mentioned.

It was apparently made for a Christmas tape and never broadcast. But now it has a home on the intertubes.

I'm still a beliver.
There is Pirate Willy & they do conceed that it sounds like Master Bates. There are other hidden meanings, like the play on words with the FlyingDustman.
To win a court cases doesn't mean it's true.

Any term extensions in the Bill? I've been rather enjoying the amount of Looney Tunes cartoons that are now out of copyright in NZ...

Argh! I was really hoping they'd remove that contracting out provision...among other things.

Well, I guess our secret mole in the Committee is on progress to build a piece of legislation that will continue to force consumers to revolt and break the law. Good work!

It may not be too bad. They'll have the right to agree with you something else, but they'll have to be pretty clear or face the wrath of the consumer guarantees act.

They don't investigate car thefts or burglaries, so why should time-shifted recordings be especially privileged.

So that means that those of us who do not have broadband access to the net, would only be able to watch TV progs as they're being broadcast???!!! No time-shifting and no possibility of using the ondemand service?

A friend of mine who is a legal secretary in Oklahoma says it's illegal there to own more than two sex toys - that indicating intent to supply.

Always important to keep in mind clause 1 of our unwritten constitution.

"Laws of silliness, stupidity and downright unenforcibility shall be rendered void by the simple fact that the majority of the population will ignore them."

(Clause b does however state that cunning lawyers will endlessly extract many guineas from the halfwits who construct the nonsense in the first place - these legal chavs then go and spend the money on cheap wimmin and expensive wine, thereby stimulating the economy. Everyone's a winner)

Of course this tripe may simply be a gesture to a "Free" trade agreement with the land that sanity forgot.
