    This goes way beyond "this may be the only option, so we might want to put controls around it". It's not as simplistic as "I want to privatise the army," but it seems very close to "if it's the only option, I'm prepared to privatise the provision of military services historically provided by government military forces.

    Graeme, I think your point might have more validity if the UN *had* an army to privatise. They don't. What they do have (and this is what I took Shearer to be reaching for) is that they have a bunch of countries who will provide a mandate to do X. They will not necessarily then provide the wherewithall to do X (or even X-1) because of their domestice political agendas while still suggeting that X remains A. Very. Good. Idea.

    At that point looking for private solutions is as much 'privatisation' as saying that my actions in investigating the market for a flux capacitor is equivalient to me privatising the provision of my domestic time travel needs.

    Seems to me that that is misleading the court, if the judge is so inclined (I would be, but that's me). Also, IMHO, Dame Susan would be justified in taking Grieve to the Law Society for "conduct unbecoming". Graeme?

    Grieve is claiming to know nothing and that it was Veitch's father who solicited the references.

    I would be *very* surprised if it turned out that anyone on the legal team had knowingly have put a misleading character reference before the Court in circumstances like this.

    If they did, I suspect that a law society complaint from the referee (or indeed from the judge herself) would be only one of their worries . Anyone who did would find that the next judge will very likely not believe you when you hand up a reference on behalf of the next client. If they worked for a firm, they would also be likely to be looking for new employment the next day.

    Isn't that Contempt of Court, or even Perjury?

    It's not contempt or perjury, but if she was deliberately misled as to the purpose for which the reference was sought it is (at least arguably) a breach of the lawyers' obligations as officers of the Court.

    I imagine the judge will be none too pleased with the idea either.

    This whole break fee issue has me a bit puzzled. Would people be sympathetic to the banks trying to dump the fixed rates if rates had gone up?

    In the end, we signed up for the rates and the break fees. We made a bet and some of us will have lost it.

    Still and all, given that the interest charged on a 25 year mortgage makes the break fee look puny - I'd intrigued to know what the banks are saying to people who say "I know I signed up for this break fee, I know you are entitled to charge the break fee, but if you do then my business and all of that interest is going elsewhere."
