  • Hard News: Hell's Bells,

I don't see what difference it makes whether Larrakin created the work or acquired the rights to it by other means. Copyright is a commodity that can be bought and sold. I don't see why that is a bad thing.

BTW I'm not justifying the Larrakin decision to sue - I could attempt to, but I'm not really prepared to fight a 100 page copyright flamewar. I'm just saying that the fact they weren't the creators doesn't trouble me.

Of course, given my day job, I may have a certain bias...

  • Hard News: Hell's Bells,

If anyone needs any help 'applying' for copyright, I'm more than happy to help out for my usual fee of $500. Cash.

Talk in the media of "copyrighting" anything tends to get my blood up.

  • Hard News: Hell's Bells,

Yesterday saw the release of another major Australian copyright decision. In a landmark case the Australian arm of the Motion Picture Association sued the ISP iiNet - and lost.

Will I be hauled through the streets and battered to death with tire jacks if I say that AC/DC are truly awful?

    Don't worry - I'll attempt a rescue. From a distance though.

  • Hard News: Hell's Bells,

I'm buggered if I hear enough of a resemblance to warrant 60% of royalties being awarded

Damages have not yet been determined. Larrakin are making noises about 60% in the hope they'll scare the hell out of EMI and the other defendants and encourage them to settle for a reasonably meaty amount (e.g. 20%). Standard litigation tactic.

  • Hard News: Start with your conclusion,

I need to be working on this paper about the relationship between Rumours and conspiracy theories

I always suspected there was something iffy about that Fleetwood Mac album.

An interesting cover for that edition of Investigate.

I haven't read the mag, but how exactly does Cameron Slater risk the clink? Did our name suppression laws change?

Or is Wishart making stuff up again?

  • Field Theory: The Sad News Springboks,

    Amy:

It's a pretty well accepted fact that in the lead up to the final a betting syndicate and SA rugby officials conspired to diminish the ABs chance of winning.

I must have missed the news. All I've ever read and heard is a lot of rumour and innuendo.

Sean Fitzpatrick, who has the most honest face in sport

Butter wouldn't melt in his mouth. Ask anyone who opposed him on the field.

Dude, the truth is out there

Sure, but before I hitch my wagon to this particular conspiracy theory I'd like to see some actual evidence.

Andre, I've no idea what the attack on the Togo soccer team has to do with the alleged poisoning of the ABs. Are you suggesting the same people were behind these events?

We lost in '95 for a number of reasons. One of them may have been food poisoning. Or perhaps we cracked under pressure. And in '07 we just played dumb rugby and left our fate in the hands of an incompetent ref.

  • Field Theory: The Sad News Springboks,

The fact that the '95 AB's were poisoned was almost as bad as Wayne Barnes blatant bias and cheating last time around. WTF are they going to do this time?

This nation needs to get over the fact that it's not always someone else's fault when we lose a game. Wayne Barnes had a shocker in the '07 game we lost, but we could have/should have won had we played smarter. You can't alway rely on the ref.

As for the poisoning allegation, it's clear that a number of ABs were sick, and that it could have affected the outcome of the match. But "Suzie", and the conspiracy to poison the ABs, probably never existed. No reliable evidence of a conspiracy has ever been uncovered.

  • OnPoint: Google to Embargo China,

This debate on whether we have or need a constitution is an interesting one, but the assumption a written constitution would somehow protect us more than our current bundle of constitutional laws and conventions needs to be challenged.

None of the countries I can think of that have written constitutions have been without constitutional issues and challenges. Many of those countries are in fact highly unstable.

Of those that aren't the US is often cited as a positive example. But consitutional issues nearly destroyed that nation in the19th century. And the politicisation of the US Supreme Court nomination process makes a mockery of any suggestion that the US constitution is "neutral".

That's not to say an overridiing written constitution is a bad thing. I just suspect it matters less to a nation's stability than other factors.
