I'd like to see that opinion, if you have access to it. As far as I am aware, it's not been made available online anywhere.I believe 3'7 and Wingnut had a legal opinion from an equally prestigious firm that said the opposite. Certainly that was the view of the Attorney General and Crown Law. (Neither of those are available online either, sadly).
My experience of lawyers says if you have 5 in a room and give them the same problem, you'll get as many opinions as you can afford. But I wouldn't be inclined to ignore one from Crown Law.
Also, SPADA is the only entity that NZAE could have negotiated with, on this basis. NZAE were saying they wanted to talk to 3'7. Jackson, having his own legal opinion that it was not legal, has always refused on that basis, and that has been supported by Warners, who have more lawyers than you can shake a collective agreement at.
As to democracy, were the members consulted and given a chance to vote before NZAE asked its international siblings to advise their members (incorrectly) that The Hobbit was a non-union production and that they should not sign any contracts to appear?

In 2010 New Zealand Equity has continued to grow in numbers and in strength of purpose; by mid-year 50 more members had joined their union.
Which, added to Pat Hackett's 89 means around 139 members at the time this dispute began. (where did you find that report, BTW, Pat? It's eluding my eagle eye)

On the campaign front, NZ Equity’s call for a standard contract is continuing with an online petition encouraging the Screen Production & Development Association (SPADA) to meet with us to begin negotiations.

Freelancers
A landmark decision by the Australian Consumer and Competition Council has this year granted the Alliance a waiver from the Trade Practices Act, empowering the union to negotiate a collective agreement of behalf of freelance journalists with four major media companies – Fairfax, News Ltd, Pacific Magazines and ACP. We have sought talks by writing to the companies.
To support these talks the Alliance is initiating a survey and review of our freelance membership to provide the sort of comprehensive mapping information that will be necessary to underpin the campaign.
The Alliance has been assisting the development of freelance networks in Sydney, Melbourne and Brisbane to help build these communities.In my experience with Aussie companies coming to NZ, they often arrive with the idea we're just another territory looking to become a state, and that what works there legally will work here as well. Not excusing them, y'understand, just looking for answers...
