  • Legal Beagle: Gerry Brownlee is…,

    Flight Club, the rules....

The trespass offence has probably the strongest argument, but it is still weak, because Brownlee asked for, and received, permission to be where he was, which make his actions the antithesis of trespass.

To do that though he had to first confront a sign saying 'Exit only' - which surely fulfils the below requirement, which you linked to...

    Trespass*
Every person commits an offence and is liable on conviction to imprisonment for a term not exceeding 3 months or a fine not exceeding $2,000 who, without reasonable excuse, enters or remains within any aerodrome or any building or area in which are operated technical facilities or services for civil aviation, when directed not to enter or not to remain by a person duly authorised by the Director in writing for that purpose, a constable, or an aviation security officer, or by notice posted by one of those persons.

...and doesn't the above also state that 'imprisonment of (up to) 3 months' is a possibility for at least one Civil Aviation offence
    - I suspect John Armstrong and the APN subbery have allowed a transposition of numbers - ie $3000 fine and 2 months prison in stead of the correct 3 months imprisonment and $2000 fine...
    - which doesn't surprise me in the least.
Fairfax ain't much better - in an article on grammar and style a coupla weeks back the SST bemoaned the 'rules' about 'split infinities', yesterday they were talking about 'toanga' instead of 'taonga' - how we laughed....

*<edit: all a moot point I guess, as, as you say 'he wasn’t actually charged under that section.'>

    Nothing without Labour...
Seems to me that Andrew Little is 'old school Labour' - and that's not a bad thing - I'm thinking that the party members and voters - heck, society in general - is what has changed...
I vote we give him a chance to settle in, take stock and start implementing his vision before prematurely pronouncing the death of Labour - as with any experimental medicine the new solution has been mixed, we must now wait to see how it tests in various real world situations - and not presuppose its efficacy or outcome based on personal preconceptions or biases.
I fear that a breakaway group of disillusioned Labourites would dilute any chance of creating a viable and coherent opposition, let alone a government at the next election.
National seems to have a charmed life as far as getting away with heinous gaffes and misdirections, that can't last forever, there will be a watershed moment (or we will be living in a seriously f**ked up world)...

Today's take is that it was the inappropriate jokes

In his first interview Sutton said he had been an idiot, a juvenile who had gone too far too often. Always with the jokes.
He had not behaved like a public service chief executive. They were cut from a less colourful cloth.

    - one hopes John Key might learn from this...

    the latter

The 'Sutton considers his future' story has now been updated:
'Roger Sutton sex claim taken seriously'

Rennie said he received the investigation report on Friday and was communicating his response to the relevant parties.
"The outcome of this process will be made public as early as possible next week," Rennie said. Sources have claimed the release was being timed to coincide with the Labour leadership vote.
Over recent weeks, the commission has used the protection of the Official Information Act to refuse to answer questions. As late as Friday afternoon the communications team said that questions of whether Rennie met Sutton that day were going to be treated as Official Information Act requests.
Although the act requires the commission to provide answers to requests as soon as "reasonably practicable", a series of questions with yes or no answers have been unanswered for several weeks.
State Services Minister Paula Bennett has expressed confidence in Rennie.

(give ’em an inch) the game is afoot…

Sources said the commission was planning to make an announcement on Sutton early next week, timed to coincide with the Labour leadership vote.

Snap! I was gonna comment on that too…

Maybe Labour could bring their announcement forward (or delay it) – if it is chess they are playing…
hard to fathom their thinking, are they assuming their announcement about Sutton’s alleged larrikin behaviour not befitting a CEO, will swamp the new Labour leadership announcement or vice versa?

Either way it is bloody cynical behaviour – much the same as the media’s blanket coverage of Phillip Smith’s escape and capture has smothered coverage of many more pressing stories – and they aren’t really even digging into the systemic failures and lax attitudes of the Corrections and Immigration ministries (and the six years National has had control of these portfolios), mostly the media seem to be just trying to make him out to be some crime king or whimpering naif, they oscillate… and vacillate pointlessly.

Meanwhile the US wakes up (well the Christian extreme anyway) to the implications of the TPPA, being negotiated in secret in their name…
