It would be worthwhile to go and sit in the Employment Court and hear the arguments for and against the injunction being sought by the union to stop the permanent contracting out - any one interested should get along if they can.
If an inunction is granted it may be that the POAL may be only able to organise a temporary workforce until the main action bought by MUNZ is heard on 22 March 2012.
It grates, that I am hearing on the radio at least hourly the POAL apology message, as a rate payer I abhor this waste of Public Resources.
It is really only the executives appointed to publicly owned or largely publicly funded concerns that waste resources on PR offensive – after all it is not as if they have to bear any consequence.

In short, I don't think this would be solved if the Council said "oh don't worry, just get us 6%"
What I meant to say earlier was - That 6% is the return, by admission of the Mayor and POAL, that they were getting and this return was above parity with the returns of most other ports.

Willie Jackson is as big a patsy as Len Brown - they are both stupid people out of their depth, they do however show that the witless can prevail - never overlook the power of stupidity coupled with determination and self-interest.
Len Brown if he had gonads - which we now know he does not possess - should have looked to, if he had the greater interest of Auckland at heart, chair/facilitate a mediated process of weeks duration not hours. What a limp wrested load of hand wringing bollocks - IMHO.
You will begin to see evolve in industrial relations the role of bargaining agents concluding agreements – that are workplace or site based - rather than unions representing workers in collective bargaining.
It is highly likely that some of the bargaining agents will be to a greater or lesser degree associated with the once, twice or thrice removed employer groupings – like say POAL - engaging AWF to engage the casual work force that the bargaining agents will represent.
With the rise of bargaining agents and the demise of the union movement PG and other claims will be weakened and costly for workers to pursue, funding for the Labour Party will decline and workers will not be able to get representation on the wide range of issues that affect them. The knowledge and the skill to fight for workers rights will be distilled down to nothing – it isn’t far of it now.
The wider union movement should have put on a far better showing at the march in support of MUNZ – the EPMU hardly had a presence – they must have over 30 Reps in Auckland so you would have expected some sort of presence and the PSA – well I understand they sent an e-mail out to members/reps some time after 5.00 PM last Friday asking them to march in support of MUNZ.
So what we are getting is a political environment where the opposition is hobbled/nobbled and effectively a one party state emerges – the founder of which will be First Citizen John Key the First – he is so great – look at how his natural adversaries are in a state of permanent and terminal disarray - the token opposition.

My feeling is that the direction this dispute went and is presently progressing was well set before the dispute emerged, perhaps likely well before the collective expired and possibly even before the lead up to the last election.
It is interesting (tenuous perhaps) - in the Teapot Litigation Andrew Caisley of Kiely Thompson Caisley acted for John Key - Kiely Thompson Caisley have been appointed to the govt panel providing advice on employment matters and if you look at the flurry of recent early March 2012 Employment Court judgments Caisley & Franks - or KTC – are largely acting for a number of the Port Companies.
It is also Interesting - the injunctions sought by other Port Companies against other watersiders taking industrial action in support of Auckland Watersiders whilst under a collective agreement was made under urgency – whereas the injunction sought by MUNZ on the bad faith act in mass dismissal will be heard in about two weeks time and it may well be a further few weeks before any decision is handed down.
What I consider we will likely see in upcoming Employment Law Reforms will be the removal of the object of the Act to promote or even conclude collective bargaining and the removal of the fourth week of annual leave – be it by a buy back – where the fourth week is used as a factor to reduce wage claims - or statutory leave is reduced to three weeks.
What is happening now and is going to happen won’t be positive for anyone – this includes the POAL, Auckland City, ratepayers and the economy as a whole. The thing is being taken to the brink of insanity based on the pursuit of loose ideological nonsense.

Yes, yes, clearly the major problem in this conflict was the failure of Shearer to put
out some press releases.These are your words not mine.
Shearer's job is to get elected and implement good policy. It's not to get involved in industrial disputes. That's Helen Kelly's job.
If Shearer/Laour are looking to motivate the large number of registered voters who did not vote - likely Labour voters - he/they had better stand up for something - he/they can't be the neither for nor against he has largely been on the POAL dispute.
By comparison Goff has been onto it as regards MFAT issues.
