It wasn't a criminal investigation. The character alleged to have made homophobic statements was not the accused but the complainant.
Lack of comprehension is a defect which can be cured by education and training. It's not a crime either, but I recommend the treatment.

So I woke up [in the dream] and went to the loo and did my business, and then before I had returned to the bed I really did wake up - fortunately the very realistic micturation had only been part of the (outer) dream! Yes; I didn't like the Lockwood designs particularly and I strongly resent the way the PM has appeared to be gaming the process, but the first time I saw fabric versions of the old flag and the black Lockwood flying side by side my overwhelming reaction was simply "oh no, that's a really naff blue".

As somebody said on Twitter, the black Lockwood design is just the current flag with the Union Jack swapped out and the All Black fern swapped in.
