    But I do draw the line at shrugging one's shoulders at a video of a man stuffing a chicken in a manner not to be seen on the Food Channel being shown in my hone (the one part of Wishart's story Broad has not denied, BTW), then saying 'well I was young, mistakes were made, I thought my career would suffer, it would never be tolerated on my watch, blah blah blah'.

    I thought it had the ring of truth. Junior cops who filed complaints against other cops in 1980 probably weren't likely to have long careers with the police.

    Interestingly, there were some far more senior police also present at the gathering, including the late, and well-respected Gordon Hunter. You'd think it would be more up to them to act than a 23yo constable.

    Anyway, I've made what I can of the claims in this morning's post. And Neil, I agree about Karam - whatever good work he might have done in defence of David Bain, he has also behaved like a rather loose unit at times.

    Re the Blog Awards - I've spoken about this before, and I think it'd be a bit of an unecessary wankfest to be honest. Like, firstly there's bugger all blogs in NZ - even fewer seriously viable ones - so with enough categories everyone would be sure to come home with a trophy. Is that really what we want, some mutual appreciation backslapping kinda thing where even cyfswatch come home with a Hardest Tryer Plaque?

    I like the idea more in terms of emphasising that political blogs aren't all there is to the medium. There are various good little business and specialist blogs that would benefit from the exposure. And you'd be surprised how many blogs there actually are.

    GOVIS turns me into a criminal. It's a funny old world.

    The URL wouldn't paste into Windows Media Player and I couldn't save the movie via Flip4Mac - but what I could save was a file called GenerateDynamicPlaylist.aspx, which did launch the stream in Windows Media Player. With sound!

    Why are they doing it like this?

    And a little hint from the Lobbying 101 playbook: Most people don't find being urinated on in front of a large audience endearing. Something to keep in mind if you're trying to make friends and influence people around the corridors of power.

    The music people were horrified by what happened to Brash, for that reason and out of sheer courtesy. IIRC, RIANZ publicly apologised.

    The perps were actors: Oliver Driver and Anthony Starr, who was particularly boorish.

    But upheld the rule of law.

    I don't remember a lot about the case, but believe, whilst a decision the other way might have been objectively better, it would also have ignored the law.

    Except, unfortunately, we seem to be the only country that actually had to live with the Baumol-Willig rule, rather than simply have it as something for economists to muse about.

    The Appeal Court rejected Baumol-Willig as "obviously anti-competitive" and suggested that everyone go back to the drawing board. Both parties went to the Privy Council - Clear seeking damages and Telecom seeking to overturn the decision.

    At issue was the meaning of parts of the Commerce Act. Ministry of Commerce officials strongly opposed Telecom's case on the grounds that it would prevent competition, but the PC decided to apply an economic principle that did just that.

    I am of course no expert, but it seems to have been more a matter of deciding what to do about the law than simply upholding it.

    Yes, so far as I can tell it's not possible to hotlink to any particular video, and if you try, you link will go to the wrong page altogether.

    The clips are WMV: fine, I've got the Flip4Mac components for QuickTime on the Mac. Except it looks like they're using an audio codec that isn't supported by Flip4Mac. I'll go and update the components and see if that helps, but, honestly, what a sucky way to present some potentially excellent resources.

    While I would not belittle the upper echelons of the NZ justice system, not only are the Law Lords extraordinarily smart people, their isolation from NZ makes them far more "blind" to external influences and more independent than any NZ court could ever be.

    OTOH, the Privy Council did us no favours at all in the Clear vs Telecom interconnection dispute. It overruled our Court of Appeal and gave Telecom what amounted to a monopolist's charter. That decision hurt New Zealand.
