Ting Tings should have been on a little later then I'd have got to see them . I hope the datsuns havn't lost that garagey loose humour they once had , its not that I particularly dislike Shihad its just that one Shiahd might be enough . -

yes well tis the holidays ... fast fading , but speaking of BDO , anyone at Spiritualized the other night at the power station ? gee it was really pretty great , one of the best . We were almost shot into
orbit . -
wow that Likke Li - Bon Ivor busk is really cool ... the Beirut gig late summer this year at the KA or (kingys) as the kids call it, sort of had a similar feel . A little over sold, but pretty cool all the same, a really folky quite fragile performance - one of my fav gigs of the year .Any other favourite 2008 gigs ?

hmmm the kooks really are a shocker of a band truely insipid although yes the cover of kids is ..er... okayish . Not a patch on the original though as John Peel would have said - really , whats the point ? As for BJM sounds like that could be a guietly evolving riot of a show , just tried to get tickets but alas its sold out apart form a few door sales . drat . The KA will be rammed and very up for it tonight I'd say .

Hard News: Don't call it a consensus,
meanwhile - two recentish releases I have been lovin lately are the two most recent albums by The Fall - Reformation TLC, and the album before that Heads Roll . Having off and on tuned in and out of the Fall over the passed 25 odd years , it seems right now they are firing - on all cylinders . Go Mr Smith .

In my Trial experience from the Defence perspective, the 'cluttered' view of the jury just about always benefits the accused . If, on the face of it, the prosecution evidence appears reasonably compelling an accused is always better infront of a jury . If the prosecution evidence looks pretty weak I would be tending to elect judge alone trial which is pretty much always an option , even if by special pre trial application .

Hard News: Tapped out and meanwhile ...,
the police roadblock and photographing people in that small town in eastern bay of plenty was unlawful- end of story no question . It was also complete over reaction and utterly unnecessary and definitely intimidating for those on the receiving end.I kinda thought there might have been something in this at first .... but now i doubt there is much in it at all . Pretty lame Police behaviour , they should apologise.There just was no imminent threat, execution of normal search warrants on specific houses at dawn under existing uncomplicated Criminal legislation, as is the norm, would have sufficed. There has been over reaction from some in Maori hierarchy, but certainly in this blog there was i think over concern about what ....'maybe going on'.... particularly anecdotal reports ....Bomber etc as i recall; at the expense of the bigger issue - yet another stoopid bust on the poorer folk in this country . I'd be pissed if I were them .

To date interception warrants are used most commonly to obtain evidence in the prosecution of Crimes against the Misuse of Drugs Act . At Trial with respect to those prosecutions all aspects of the warrant - the obtaining of, the way inwhich it has been used, and the time period - will be rigourously challenged. Often in those Trials challenging admissability of evidence obtained from interception warrants will be the only real avenue of defence available . -
