Meanwhile, video of a voting machine that keeps flipping votes from Obama to Romney.
It's a pity they didn't show attempting to get Obama via Jill Stein, to prove it's not just a screen calibration issue. The guy just talked about it, which is much less believable. One is a simple fault, the other highly malicious, illegal intent.

Yeah, I watched that video and thought "well, crappy touchscreens are not unknown to mankind." It's problematic, not conclusive.

Indeed. Crappy pens too, but fixing them only requires getting another one out of a box.

I see fivethirtyeight are now at 92.5% chance of an Obama victory with a “most likely” result of 315.3 Electoral College votes.
I'll take that bet. Name your odds. I'll put $100 on Obama not getting 315.3 Electoral College Votes :-)

I too suspect that the current showing Electoral College esitimate 313 is infinitely more likely (literally) than the 315.3 of yesterday.

You are right! I just had it filed as an equal protection clause case, but I didn't remember the weird Florida stuff that went on over the top of that.
(But for people purely interested in who gets to make decisions about how us elections work, Bush v Gore does illustrate there's a play between Federal and State level actors.)
