I just saw an cartoon, unfortunately not so great, making the point that unpluggable leaks have been rather a feature of US politics lately.
in re Bradass87, I was left with the impression everyone though he probably had a tonne of stuff. I'm not sure anything Assange's said is properly inconsistent with this timeframe. (haven't followed assiduously)

I may have remarked before that every other maker of touchscreen tablets must have spit the dummy with all those news reports: "And what's more - you can read books on it!!!!!111!eleven!!!"
And just because it was today, a guy sent me this dress-up Obama web toy demoing his open source webpage scrolly thing for touchscreen (also works in opera/chrome/safari, you'll' need to make the window narrow on a PC) made with bit from my 2008 Seven Costumes. I feel quite proud.

Further to your 'common sense' angle, Eric Crampton points out the Treasury guide to cost-benefit analysis:
Have you miscounted the use of real economic resources as a benefit? For example, the costs of building a stadium (materials, labour etc) is not a benefit to the economy. Often the jobs created by such projects are just a transfer from elsewhere in the region or country.

AFAIK terms of use that rely on people's passive consent, or say "by doing [something you would expect to do anyway] you agree that ... ", don't tend to enforce all that well. And if you can view it as a contract, in the context of the site it's very small print, which is another problem. Though linkers have probably read and understood if they're asking that question.
