    The decision re the disclosure rests on the facts of this particular case and has regard to the defence being run by Slater.

    If you look at [9] of the judgment - Slater has admitted the publication of the material and admits, in some instances, the defamatory meanings (that are pleaded), Slater relies on the defences of truth and honest opinion and has produced a list of the particulars (docs etc) that he relies on to support the defence he is running.

    The purpose of discovery is to assist the decision maker in making a decision. To eventually make a decision the judge needs the “particulars” disclosed that Slater says support his defence.

    The judgment does not consider the material published by Slater, the material that is the subject of the proceedings, are protected as New Media/Medium under s 68.

    The judgment does not modify or create a precedent that lessens the purpose of s68. The judgement deals with the materials published by Slater in this case – not the wider blogging universe.

    The judgment is pretty sound – what it does is signal to Slater the nature of the materials published are such that he cannot rely on s68 to defeat the disclosure sought.

    The judgment here is not the end of the world, it would be a twisted world that casts Slater as a champion of the rights of others.

    I feel Slater will likely challenge the judgment, the judgement will stand, Slater will refuse to attend to disclosure and will be held in contempt of Court – Slater will play the victim and milk it for all it is worth - perhaps he will end up in custody for failure to attend to disclosure.

    The Police need to acknowledge the omission to treat the complaints seriously is unacceptable whilst also progressing the inquiry.

    If the Police seriously want people’s opinions of them to change they need to demonstrate that they have changed their behavior and culture. The emphasis on counter PR measures and damage control is a wasted.

    Marshall instead of taking things personally and phoning people should be more concerned with setting things right in the Police force and in particular in dealing with an investigation into the gang rape allegations made by the four victims, that is after all the job of the Police.

    However, until you can provide me evidence that this entire saga is about glossing over the involvement of a cop’s son, you’re not going to get me to concede anything like what you’re seeking. Fuck’s sake,

    I feel as far as the Police are concerned evidence doesn't matter - ironic as it is - evidence can be made up, destroyed - it is largely malleable for purpose.

    The entire saga is about many things that include "glossing" over the involvement of a group of young males, that include a police officer's son, who have, by their own admission in social media, stupefied and raped for a sustained period with impunity till now.

    People have a right to express outrage at the whole situation and are right in doing so , for you to be rankled by that expression and to trivialise it to mere trend is belittling of that concern.

    I find you closing comment pretty distasteful and also resorting to the words “Fuck”, “Fuck’s sake” insensitive in the circumstances, bearing in mind that at the core of this is the rape of minors.

    The manner you are expressing yourself shows has no sensitivity or compassion for the victims. I feel you really need to think hard about the issues – your locking horns and abuse are all about you with little consideration for others.

    The lack of consideration for others and readily resorting to abuse are the seed of problem – it appears so ingrained in you that you are unlikely to see it.

    Leaving the officers involved in place will skew any IPCA inquiry.

    A level of wilfull neglect that is disgusting and worse it is likely to be a common occurence in "police operations" on a national basis. The Police are not in a credible position to assure that "this" is not the case.

    People need to step aside NOW.

    In dealing with the PR storm the Police will spend/allocatre a greater level of resources than would have been involved in seriously investigating the complaints.

    We need to have confidence in the Police - The budget considerations no doubt stretched to accommodate the KDC raid in Jan 2012 - so the Government can see to it they accommodate the resourcing required for the police investigate complaints of sexual assault and the gang rape of minors properly.

    The police officers who handled the initial complaint case and the chain of police who have misled the entire country should be stood down and the Minister should initiate a commission of inquiry - if this doesn't happen the opposition should constantly call for the resignation of the Minister of Police and an inquiry.

    Dependant on the outcome of the inquiry those that misled the public and the minister either wilfully or by omission should be gone as should the officers who handled the 2011 initial complaint.
